Wie kann es dann eine mittelbare Taterschaft uberhaupt geben, bei der jemand durch einen anderen handelt und wie lasst es sich begrunden, dass der Anstifter gleich einem Tater bestraft wird, obwohl die Hauptverantwortung doch der Angestiftete tragt? Einmal anerkannt, dass es mittelbare Taterschaft und Anstiftung als unterschiedliche Beteiligungsformen gibt - wie grenzt man sie voneinander ab? Die Arbeit behandelt diese Fragen und uberpruft die scheinbar unumstoesslichen Auffassungen von Rechtsprechung und Literatur auf der Basis einer Rechtsphilosophie der Freiheit.
