Purchased on May 2nd. On May 29th seller still had not shipped or communicated, so I opened a case. After I opened case, seller checked in and asked if I still wanted item shipped then I need to "CLOSE THE ISSUE so I can start up sending it out!" I said "no" b/c I could not re-open the case and would lose my protection. Seller would not send me my item telling me there no issue anymore since he "said" he will send it and until I close case he can't send it. Ebay ruled in my favor on June 4th.

You would have not lost any protection. Ebay has all of the messages between us and since the case was open, it would not let me send it out. My solution was to send it out, that was the reason to close the case. All he had to say was send me my refund if he was wary but instead puts a negative review. Albeit it was my fault not sending it out on time because life happened, I was willing to make it right in any way possible.
