Sold as new, but marked scratched/damaged, re-painted and repackaged. But it will meet my needs and the price was right. Scratches are a minor issue on a stainless steel exhaust and the black painted tip is under the bumper once installed. So I would have purchased it, even if the description was accurate and I’m satisfied
