When something arrives where the disc itself is dirty, covered in greasy marks and a few crumbs and has surface scratches on it, that's not what I call 'near mint condition'. Suggest that the seller gets some new glasses. However, after cleaning, it plays which is the main thing so I won't be returning it, but suggest your description needs a dose of greater accuracy.
