Le restituzioni per DIRITTO DI RECESSO sono regolate dall'art.52 del D. L. 21 febbraio 2014, n. 21.

L'articolo 47 del medesimo D.L. elenca invece le "esclusioni " che coinvolgono anche l'art. 52 ovvero le ESCLUSIONI al DIRITTO DI RECESSO. Riportiamo qui di seguito il punto 2 :

" Le disposizioni delle Sezioni da I a IV del presente Capo non si applicano ai contratti negoziati fuori dei locali commerciali in base ai quali il corrispettivo che il consumatore deve pagare non e' superiore a 50 euro. Tuttavia, si applicano le disposizioni del presente Capo nel caso di piu' contratti stipulati contestualmente tra le medesime parti, qualora l'entita' del corrispettivo globale che il consumatore deve pagare, indipendentemente dall'importo dei singoli contratti, superi l'importo di 50 euro".

Per tanto non sussiste DIRITTO DI RECESSO per oggetti il cui corrispettivo pagato sia inferiore ai 50 euro. Tuttavia noi aderiamo alla politica di eBay che promuove un "RECESSO DI CORTESIA" approvando anche restituzioni per articoli di valore inferiore ai 50 euro ma in questi casi applichiamo le seguenti condizioni:

Gli oggetti di prezzo inferiore ai 50 euro restituiti per RIPENSAMENTO o RECESSO se restituiti dopo essere stati usati, intallati, provati o anche soltanto privi della confezione o con confezione non più sigillata saranno rimborsati al 50%.

In qualsiasi caso i costi di spedizione saranno rimborsati al minimo prezzo fra quelli pubblicati in fase di acquisto; (art.56, comma 2)
