Rückgaberecht / Widerrufsrecht

Alle abgeschlossenen Kaufverträge, die dem Versand unterliegen sind sogenannte Fernabsatzgeschäfte. Sie unterliegen dem § 312 c Abs. 1 BGB i. V. m. § 1 BGB Info. Holt der Käufer die Ware persönlich oder durch eine von ihm bevollmächtigte Person in unseren Geschäftsräumen ab, so handelt es sich nicht mehr um ein Fernabsatzgeschäft. Der Kunde hat die Möglichkeit die Ware in Ruhe zu prüfen. Der Verkäufer ist nicht verpflichtet, die Ware zurückzunehmen.

Eine Rückgabe der Ware außerhalb der gesetzlichen Frist ist nur aufgrund einer schriftlich zu schließenden Individualvereinbarung möglich, die einer Erstattung einer Aufwandspauschale von mindestens 15 % des Ersteigerungsbetrages zugunsten des Verkäufers ausweist. Diese Vereinbarung wird nur wirksam, wenn der Verkäufer dem Käufer die Sache schriftlich bestätigt. Mündliche Vereinbarungen sind nichtig und unwirksam. Die Garantie- und Gewährleistungsrechte bleiben davon unberührt.

Schadensersatzansprüche des Käufers sind – gleich aus welchem Rechtsgrund – ausgeschlossen; dies gilt nicht für Schäden, die auf einem vorsätzlichen oder grob fahrlässigen Verhalten des Verkäufers beruhen.

Zur Durchführung der Rückgabe hat der Käufer die Ware an den Geschäftssitz des Verkäufers zurückzusenden. Eine Rücküberweisung des Betrages erfolgt erst nach Eingang der Ware in unserem Hause und nur, wenn dem Paket eine Kopie der Originalrechnung mit dem Namen des Kunden und dessen Bankverbindung sowie einer Begründung des Rückgabegrundes beigefügt wurde.

Der Verkäufer verpflichtet sich, den Betrag innerhalb der gesetzlichen Frist von 30 Tagen nach Eingang der Rücksendung an den Kunden zurückzuzahlen. Der Verkäufer behält sich vor, bezahlte Ware, die nicht verschickt werden kann; insbesondere Ware für die Schweiz, anderer EU-Länder sowie sperrige Ware zum erneuten Verkauf wieder freizugeben, sofern der Kunde diese nicht innerhalb einer Frist von 14 Tagen persönlich in unseren Geschäftsräumen abholt oder Übersendung innerhalb von 10 Tagen auf sein eigenes Risiko fordert. Der bezahlte Kaufpreis wird dann nach Bekanntgabe der Kontoverbindung innerhalb der gesetzlichen Frist an den Verkäufer zurückgezahlt.
